innocent until proven guilty

The other day we got a friendly letter in the mail from my parent’s insurance saying that we fled the seen of a crime that we committed.
Apparently, my mom was driving her car, a Mini-Cooper, and crashed into the side of a German’s car and kept going. Luckily, the German wrote down the plate number and now we are in this dillema.
This event, supposedly, happened March 13, while my dad was at work, and while my mom was out of the country…interesting.
In Germany you are not innocent until proven guilty, in fact the accused are seen lower and basically do not have any rights. We are not even able to see a police report. We also have to pay for a lawyer to fight for a case against us, also something the court provides in the US.
Basically, they think we hit this car, left, got our car fixed and now our insurance has to pay for them… (The last time we got in a car crash, a drunk German swerved into our lane, hit us head-on, and left the seen. It took 6 months to fix the car)
My mom’s mini has no scratches on it, she would never let that happen, but we are the guilty ones in this case. Americans have no rights, we can’t get the name of the accuser and can’t get a report of apparent crimes that we have commited.
If, and probably when, this goes through our insurance will surely raise and pay for the damages of this car.
We are getting scammed in this issue, clearly someone knows how to get over on an American and we have nothing that we can do, no way to prepare for this acquisation, and no one seems to know a way to help.
Enjoy your freedoms Americans, and don’t think that the accused get too much freedom, because here there seems to be no freedoms for the accused.

You are completely right. This whole situation really gives me a greater appreciation for our country.
